1. Acceptance of terms

By creating an account or using CosTruss, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use CosTruss. You are responsible for maintaining the accuracy of your account information.

3. Your account

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscriptions and billing

CosTruss offers subscription plans with a 7-day free trial, subject to the terms displayed at signup. Any payment-method requirements and the date on which paid billing begins will be disclosed before you start the trial.After the free trial ends, your selected subscription plan will be billed in advance on a recurring basis unless you cancel before the renewal or trial-conversion date. Subscription fees, billing periods, and applicable taxes will be displayed at checkout.Payments and Refund Policy: All subscription payments are final and non-refundable once processed, except where a refund is required by applicable law or expressly approved by CosTruss. This policy applies to subscription fees, renewals, unused subscription periods, and partial billing periods. Cancelling your subscription stops future renewals but does not automatically entitle you to a refund for payments already made.Pricing Changes: CosTruss reserves the right to modify subscription prices, plans, features, and billing terms from time to time. We will provide reasonable prior notice of price increases before they take effect for your subsequent billing period, as required by applicable law. Any revised price will apply from the effective date communicated to you. If you do not agree with a price change, you may cancel your subscription before the revised price takes effect.Cancellation: You may cancel your subscription using the cancellation method provided in your account. Unless otherwise stated, cancellation prevents future renewals, while access to paid features continues until the end of the current paid billing period.Your AI provider charges are separate from CosTruss subscription fees. CosTruss does not control or refund charges incurred directly through your AI provider accounts.

5. AI providers and credentials

You are solely responsible for your AI provider accounts and for providing valid credentials. CosTruss reads your usage data using the credentials you supply; you are responsible for ensuring you have the right to grant that access. Your AI provider bills you directly for usage — CosTruss adds no markup and is not a party to your agreement with your provider.Customer Data and ResponsibilityYou are responsible for all data, information, API keys, and credentials you provide to or connect with CosTruss. You must ensure that you have the necessary rights, permissions, and lawful basis to provide such data and authorize its processing.You are responsible for the accuracy, legality, and appropriate use of your data, including any personal data belonging to your customers, employees, or other individuals. You must comply with applicable data protection and privacy laws when collecting, sharing, or connecting such data to CosTruss.CosTruss processes data to provide its services in accordance with its Privacy Policy and applicable law. You must not upload or provide data unlawfully or infringe another person's rights. Nothing in these Terms excludes or limits any obligation or liability that cannot legally be excluded or limited.

6. Acceptable use

• Do not abuse, reverse-engineer, or attempt to disrupt the service.
• Do not use CosTruss to violate any law or third-party right.
• Do not attempt to access another user's data.

You confirm that you are only connecting AI provider accounts and credentials that you are authorized to access, and that you have the right to grant CosTruss read access to the usage data for those accounts.You are responsible for the data and information you upload, submit, or connect to CosTruss, including ensuring that you have the necessary rights, permissions, and lawful basis to provide such data. You must comply with applicable data protection and privacy laws and must not provide data unlawfully or infringe any third-party rights.

7. Intellectual property

CosTruss and its software, branding, and content are owned by us and protected by applicable laws. We grant you a limited, revocable license to use the service per these Terms.7. Personal Data Protection and PrivacyCosTruss processes personal data in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 and the rules applicable to the service.You are responsible for ensuring that you have the necessary rights, permissions, and lawful basis to provide any personal data you upload, submit, or connect to CosTruss, including personal data relating to your customers, employees, or other individuals.CosTruss processes such data to provide, maintain, secure, and improve its services, in accordance with its Privacy Policy and applicable law. We implement appropriate security measures to protect personal data and handle requests, deletion, and personal data breaches as required by applicable law.Further information about the data we collect, its purposes, retention, sharing, and applicable privacy rights is available in our Privacy Policy.

8. Disclaimers

Third-Party Services and No GuaranteeCosTruss relies on third-party services, including AI providers, APIs, hosting infrastructure, and other external systems, to deliver certain features and functionality. We do not own or control these third-party services and cannot guarantee their availability, reliability, accuracy, performance, compatibility, or uninterrupted operation. Third-party services may experience outages, delays, errors, pricing changes, API modifications, access restrictions, or discontinuation without notice to CosTruss.To the maximum extent permitted by applicable law, CosTruss makes no guarantee that the service will always be available, uninterrupted, error-free, accurate, compatible with every third-party service, or suitable for every user's requirements. We do not guarantee that usage data, cost estimates, reports, budget notifications, or alerts will be delivered without delay or error, or that any particular cost savings or financial outcome will be achieved.Your use of third-party services through CosTruss remains subject to the relevant providers' terms, policies, availability, and billing arrangements. CosTruss is not responsible for failures or changes originating from third-party services, except to the extent liability cannot lawfully be excluded or limited. Nothing in this section removes any rights or protections that cannot legally be waived.

9. Limitation of liability

CosTruss provides AI usage monitoring, cost tracking, reporting, analytics, budget management, and alerts as informational tools to help users understand and manage their AI-related expenditure. While we make reasonable efforts to provide reliable and timely information, we do not guarantee that monitoring data, usage records, cost estimates, reports, or alerts will always be complete, accurate, uninterrupted, or available in real time.Usage and cost information displayed by CosTruss may be affected by delays in data availability from AI providers, changes in provider pricing, differences in billing calculations, changes in model rates, currency conversions, provider-side adjustments, API errors, network interruptions, scheduled maintenance, system outages, or other technical and operational factors. Consequently, the usage or cost information displayed on CosTruss may differ from the final amounts reported or charged by your AI providers.Budget thresholds, spending notifications, and other alerts are intended to provide additional visibility into your AI expenditure. They are not guarantees that spending will be detected immediately, that every threshold will trigger an alert, or that further usage or charges will be prevented after an alert is generated. Delays, missed notifications, inaccurate data, temporary service interruptions, or other circumstances may result in unexpected expenditure.You remain solely responsible for managing your AI provider accounts, API keys, applications, usage limits, budgets, and billing arrangements. You are responsible for verifying your actual usage and charges through your AI providers' official dashboards and billing records and for taking appropriate action to control your expenditure.To the maximum extent permitted by applicable law, CosTruss will not be responsible for unexpected AI provider charges, overages, increased usage costs, differences between displayed estimates and final provider bills, or losses arising from delayed, incomplete, inaccurate, or unavailable monitoring data or alerts, except to the extent such liability cannot lawfully be excluded or limited.Your AI provider bills you directly for usage incurred through your provider accounts. CosTruss does not control your providers' billing systems, pricing decisions, usage calculations, or final charges. Your use of CosTruss does not replace the need to monitor your provider accounts independently or to configure appropriate spending controls directly with your providers where available..

CosTruss provides monitoring, reporting, and alerts as a tool — not a guarantee. We do not guarantee that usage or cost data is complete, accurate, or timely, as it depends on data supplied by your AI providers. You remain fully responsible for your own AI provider accounts, your API key usage, and all spend incurred on your provider accounts, including any spend that occurs before, during, or after a CosTruss alert. CosTruss is not liable for any charges, overages, or losses arising from your AI provider usage.

IndemnificationYou agree to indemnify and hold harmless CosTruss, its owners, operators, employees, and affiliates from and against third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or relating to:Your misuse of CosTruss or violation of these Terms.Data, information, API keys, credentials, or other materials you submit, upload, or connect to CosTruss, where your actions violate applicable law or a third party's rights.Your failure to obtain the necessary rights, permissions, or lawful basis to provide data or authorize its processing.Your violation of applicable laws, regulations, or third-party rights.Your unauthorized access to or misuse of an AI provider account, API key, or other third-party service.You agree to reasonably cooperate in the defence of any such claim. CosTruss will provide reasonable notice of a claim for which indemnification is sought, where legally permitted, and will not settle a claim in a manner that imposes an obligation or admission of liability on you without your consent.Your indemnification obligations apply only to the extent permitted by applicable law and do not apply to losses caused by CosTruss's own acts or omissions where such responsibility cannot legally be excluded or transferred to you.This section does not limit any rights or remedies available under applicable law.

11. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service, with reasonable notice where possible.

12. Governing law

These Terms are governed by the laws of India. Disputes will be resolved in the courts of Bengaluru, Karnataka, India.

13. Changes

We may update these Terms from time to time. We will notify you of material changes and post the updated date above.
